Question by dawnshelton1965: Legal question about payroll checks?
My b/f has been working for a trucking company since Feb. and they have just recently went to automatic deposit. He cannot open a bank account due to an unpaid loan through a bank so the company charges him $ 5 to keep his checks on paper. Now they are saying he cannot cash his check until monday and will try to keep his check from him until then. Is this legal?
So when everyone else in the company is getting paid on friday, it is ok for the company to single him out and withhold his check until monday?
The date on the payroll check if for the payday, friday, but they say he still cannot cash it until monday.
For all the idiots condemning him…he is paying on the loan the best he can but cannot open an account until it is paid off, it was a joint account and he is paying his ex-wife’s unpaid share that was court ordered by the divorce judge.

The employer can determine the pay date. Under federal law, employees must be paid at least twice monthly. As long as the employer meets this rule it is legal.
